UEH College Of Economics, Law And Government In Cooperation With The Vietnam International Arbitration Center (Viac) To Organize A Seminar On "Enforcement Of Arbitral Awards And Arising Issues Related To Third Parties"

On March 29, 2024, UEH College of Economics, Law and Governent (UEH -CELG) and Vietnam International Arbitration Center (VIAC) jointly organized the seminar "Enforcement Of Arbitral Awards And Arising Issues Related To Third Parties" at Hall B1.205, Campus B - University of Economics Ho Chi Minh City. The seminar discussed regulations related to the role, rights and obligations of third parties in the enforcement of judgments and arbitral decisions from a theoretical and applied perspective in Vietnam as well as as experiences for other countries around the world.

Attending the program, on behalf of UEH College of Economics, Law and Government, was Dr. Duong Kim The Nguyen - Dean of School of Law, UEH - CELG; Dr. Nguyen Thi Anh - Vice Dean of School of Law, UEH - CELG; together with lecturers and leaders of departments and programs under UEH - CELG.

On the part of the Vietnam International Arbitration Center, there was the participation of Lawyer Chau Viet Bac - Deputy General Secretary of VIAC; along with lawyers, arbitrators, executives of judgment enforcement agencies, and researchers from universities and businesses in Vietnam.

 

 

Overview of the Seminar

Speaking at the opening of the seminar, Dr. Duong Kim The Nguyen emphasized the importance of developing dispute resolution methods, especially commercial arbitration thanks to the great advantages of arbitration compared to other methods. In fact, it can be stated that, in addition to the parties in the dispute, the "third party" gradually appears in more cases, in many different roles, and is important in ensuring fairness, transparency, and effectiveness of arbitration and conciliation methods, thereby posing the need to continue improving the legal framework governing arbitration activities. Therefore, the College of Economics, Law and Government (CELG) has been honored to accompany the Vietnam International Arbitration Center (VIAC) to organize the seminar on "Enforcement Of Arbitral Awards And Issues Arising Related To The Third Party". This seminar is the realization of the cooperation between CELG and VIAC over the past years.

Giving the introductory speech at the conference, Lawyer Chau Viet Bac affirmed that 2024 opened up many challenges for commercial arbitration activities in Vietnam, especially when disputes involving third parties became increasingly complicated. Although the role of third parties in the dispute resolution process has been recognized, with the starting point being a private dispute resolution mechanism, governed by an arbitration agreement between the two parties, there was currently no such document. There were no legal regulations on arbitration in Vietnam that provided specific and detailed definitions of the roles and powers of third parties, unintentionally creating certain obstacles when resolving disputes using arbitration methods and conciliation.

Presenting the topic "Involvement of third parties and their influences on the process of enforcement of arbitral awards", Mr. Le Hung Long - Lecturer at UEH - CELG School of Law stated that there was a need for a unified guiding document on the concept of "third party"; at the same time, we should consider expanding the right to request enforcement of arbitral awards for "third parties" to have rights and obligations related to the dispute and to ensure effective dispute resolution activities. He believed that improving the law on "third parties" would improve the efficiency of enforcement of arbitral awards and avoid  annulment of awards.

Mr. Phan Van Thuy - Deputy Head of Operations Department I, Civil Judgment Enforcement Department HCMC and Mr. Nguyen Cong Phu - Former Deputy Chief of the Economic Court in Ho Chi Minh City, VIAC Arbitrators, in turn, presented the "Handling practices of judgment enforcement agencies as the content of an arbitration award related to the third party" and "Cancellation of arbitration awards and other matters related to third parties”. Through these presentations, the presenters proposed ideas to improve the law on the annulment of arbitration awards to protect the legitimate rights and interests of third parties.

Under the frame of the seminar, Lawyer. Dang Viet Anh - CEO of ANHISA Law Company Limited, VIAC Arbitrator presented "Proposals On Enforcement Mechanism Of Arbitration Awards With The Third Party Element" and showed typical examples to help listeners clearly understand his content.

As a senior Law training and research center in the Southern region, UEH - CELG has coordinated with the Vietnam International Arbitration Center to successfully organize a seminar, attracting the participation of hundreds of people directly in the hall and online via the Zoom platform. The seminar made significant contributions in raising awareness of the dispute resolution process by commercial arbitration and making recommendations to improve the law on commercial arbitration in Vietnam.
